Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, platform, and services provided by Make Yourself AI Inc., a Delaware corporation (“myai,” “we,” “us,” or “our”). By accessing or using our services — and, if you create an account, by indicating your acceptance at registration — you agree to be bound by these Terms. If you do not agree, do not use our services.

Enterprise customers with a signed Master Service Agreement (MSA) are governed by the MSA where it conflicts with these Terms. These Terms apply to general website use and to platform access not covered by an MSA.

1. Description of Service

myai is an AI agent orchestration platform designed for manufacturing and industrial operations. The platform enables users to automate workflows, integrate enterprise systems, and deploy AI-assisted processes within their organizations.

2. Eligibility and Accounts

You must be at least 18 years old and have the authority to bind the entity you represent. When you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3. Acceptable Use

You agree not to use the platform to:

• Violate any applicable law, regulation, or contractual obligation
• Process personally identifiable information without a lawful basis
• Attempt to reverse-engineer, decompile, or disassemble any part of the platform
• Attempt to extract, replicate, or reproduce myai’s AI models, algorithms, or proprietary workflows
• Circumvent access controls, authentication, or usage limits
• Use the platform to develop, train, or improve a competing product or service
• Benchmark the platform for competitive analysis without written consent
• Introduce malicious code, viruses, or harmful scripts
• Use AI-generated outputs as final authoritative decisions in regulated contexts without appropriate human oversight
• Exceed documented usage limits or use automated scripts to overwhelm platform resources

We may monitor usage for compliance and may suspend or terminate access for violations of these Terms, with notice where practicable.

4. Intellectual Property

The platform, including all software, models, workflows, documentation, and design, is owned by Make Yourself AI Inc. and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

You retain ownership of your data. By using the platform, you grant myai a limited, non-exclusive, worldwide license to host, store, process, and transmit your data solely to provide and support the services, and to improve the services through aggregated and de-identified analytics that do not identify you or any individual — all as described in our Privacy Policy. We do not use your data to train or fine-tune AI models.

If you provide myai with feedback, suggestions, or ideas about the services, you grant myai a perpetual, irrevocable, royalty-free, worldwide license to use them for any purpose without restriction or obligation to you.

5. AI-Specific Terms

Our platform uses a third-party AI model provider (Google Vertex AI) to process workflows. Under the Vertex AI service terms, the provider is contractually restricted from using customer data to train or improve its models and does not retain customer data beyond what is necessary to process the applicable request and meet its legal obligations. We do not use customer data to train or fine-tune AI models.

AI-generated outputs are provided as assistance and recommendations. You are responsible for reviewing outputs and making final decisions, particularly in regulated or safety-critical contexts.

6. Data Processing

Our handling of personal data is described in our Privacy Policy. Enterprise customers may enter into our Data Processing Agreement (DPA) as part of the contracting process. Our current sub-processors are listed in Section 15 below.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MYAI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR COMPLETE.

8. Limitation of Liability

To the maximum extent permitted by law, myai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of or relating to these Terms or the services.

To the maximum extent permitted by law, myai’s total aggregate liability for all claims arising out of or relating to these Terms or the services shall not exceed the greater of (a) the amounts you paid to myai in the twelve (12) months preceding the event giving rise to the claim or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above exclusions and limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnification

You will defend, indemnify, and hold harmless myai and its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms, including the Acceptable Use section; (b) your data or content, including any claim that it infringes, misappropriates, or violates the rights of a third party or any applicable law; (c) your use of the platform; or (d) your violation of any applicable law or the rights of any third party. myai will provide you with prompt written notice of the claim, reasonable cooperation at your expense, and control of the defense and settlement — provided that any settlement that imposes a non-monetary obligation on you, or that does not fully release you, requires your prior written consent, which will not be unreasonably withheld.

10. Termination

We may suspend or terminate your access at any time for violations of these Terms. You may stop using the services at any time. Upon termination, your right to access the platform ceases immediately. For 30 days following termination, myai will, upon your written request, make your data available for export; after that period, myai may delete your data in accordance with our Privacy Policy and any applicable DPA. Sections that by their nature should survive termination — including intellectual property, the warranty disclaimer, limitation of liability, indemnification, and governing law and dispute resolution — will survive.

11. Assignment

You may not assign or transfer these Terms, or any of your rights or obligations under them, by operation of law or otherwise, without myai’s prior written consent. myai may assign these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. Any attempted assignment in violation of this section is void. These Terms bind and benefit the parties and their permitted successors and assigns.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date and, for account holders, by email or in-product notice. Your continued use of the services after the changes take effect constitutes acceptance of the revised Terms.

14. General

Entire agreement. These Terms, together with our Privacy Policy and any applicable order form, DPA, or MSA, constitute the entire agreement between you and myai regarding the services and supersede all prior or contemporaneous agreements on that subject.

Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Notices. We may provide notices to you by email, through the platform, or by posting on our website. You must send legal notices to legal@makeyourself.ai.

Force majeure. myai is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or utility failures, or governmental action.

Relationship of the parties. The parties are independent contractors. These Terms do not create any partnership, joint venture, agency, or employment relationship.

Export compliance. You represent that you are not located in, and will not access the platform from, a country or region subject to comprehensive economic sanctions, and that you are not identified on any restricted-party or sanctions list. You will comply with all applicable export control and sanctions laws.

15. Sub-Processors

myai uses the following sub-processors to deliver our services:

Cal.com is used as a booking widget on our public website (see the cookie disclosure in our Privacy Policy). It does not process platform Customer Data and is not a sub-processor of the platform.
